Het besluit om buiten slapen niet meer strafbaar te stellen komt niet uit de lucht vallen. Halsema noemde het beboeten van slapende daklozen in 2021 al ‘beschamend’. Het beleid werd daarna aangepast: een boete zou alleen nog worden uitgedeeld wanneer het buiten slapen voor overlast zorgde. Toch werden er tussen 2021 en 2024 naar schatting 1800 boetes uitgeschreven. Volgens Halsema werkt de maatregel niet. "De bedoeling is dat door de boete gedragsverandering wordt gerealiseerd", schrijft zij. Maar volgens de burgemeester is het de vraag of het beboeten van dak- en thuislozen daadwerkelijk helpt om overlast door buiten slapen tegen te gaan. In de Plantagebuurt klinkt ondertussen een ander geluid. Buurtbewoners Dennis de Vreede en Job Schuring hebben een petitie ondertekend die zich verzet tegen het officieel schrappen van het verbod. Zij vrezen dat het loslaten van de strafbaarheid ertoe leidt dat meer mensen buiten gaan slapen en dat de overlast toeneemt. Toch erkennen de buurtbewoners dat beboeten an sich geen zin heeft. "Deze mensen kunnen het niet betalen en komen misschien nog meer in schuldproblematiek. Maar het hele wettelijke kader valt weg waardoor de politie helemaal niet meer kan optreden." "De kern is: help deze mensen", zegt Schuring. "Het regent en mensen liggen in tentjes. Dat is toch niet fijn?" Volgens Bianca Koster van de Regenboog Groep heeft het beboeten van buitenslapers weinig effect. "Het helpt om de zichtbaarheid aan te pakken, maar niet de kern van het probleem", zegt zij. Volgens Koster moet er vooral worden gekeken naar de redenen waarom mensen op straat belanden. Meer opvang, passende zorg en meer woningen zijn volgens haar belangrijker dan het uitdelen van boetes. "Ik snap dat als het zichtbaar erger wordt mensen denken: we moeten iets doen. Maar dat moeten we altijd.
