In Nederland overtreden veel bedrijven die met gevaarlijke stoffen werken de Arbowet. Werkgevers zijn wettelijk verplicht om bij te houden aan welke schadelijke stoffen werknemers worden blootgesteld en in welke mate. Deze gegevens moeten tot 40 jaar na de laatste blootstelling worden bewaard, maar dit gebeurt nauwelijks. Volgens Elodie Oosterhof, projectleider bij de Arbeidsinspectie, nemen werkgevers de risico’s onvoldoende serieus: "Wat wij zien is dat werkgevers het ruim onvoldoende voor elkaar hebben qua blootstelling aan gevaarlijke stoffen. Ze zien gewoon het risico niet." Dit gebrek aan registratie zorgt ervoor dat werknemers onbewust grote gezondheidsrisico’s lopen. Jaarlijks sterven in Nederland naar schatting 3.000 mensen door beroepsziekten als gevolg van blootstelling aan toxische stoffen op de werkvloer. Daarnaast worden ongeveer 14.000 mensen jaarlijks ziek door contact met chemische stoffen. Ongeveer een miljoen werknemers komen tijdens hun werk met deze schadelijke stoffen in aanraking, vaak zonder adequate bescherming. Langdurige blootstelling kan leiden tot ernstige aandoeningen zoals kanker en longaandoeningen, die vaak pas jaren later aan het licht komen. In de praktijk houden weinig bedrijven het verplichte blootstellingsregister bij. Uit onderzoek blijkt dat bij bedrijven met minder dan tien werknemers slechts drie procent dit correct registreert, terwijl dit bij grotere bedrijven met meer dan honderd werknemers niet verder komt dan zestien procent. Daphne van Doorn, advocaat bij de FNV en gespecialiseerd in beroepsziekten, noemt dit verontrustend: "Als je het niet meet en beoordeelt, weet je niet waar je je werknemers aan blootstelt. En als ze ziek worden door hun werk, kunnen ze dit niet bewijzen." Hierdoor blijven werkgevers vaak buiten schot en worden slachtoffers geconfronteerd met langdurige juridische trajecten om hun gelijk te halen. Een belangrijke oorzaak van het probleem is het gebrek aan kennis bij bedrijven over het veilig omgaan met gevaarlijke stoffen. De gevolgen van blootstelling worden vaak pas op de lange termijn zichtbaar, waardoor het risico wordt onderschat. Oosterhof benadrukt dat veel werknemers pas tijdens hun pensioen de gevolgen ondervinden: "Mensen worden misschien wel twintig, dertig of veertig jaar later pas ziek. Van de drieduizend doden, overlijdt 80 procent tijdens hun pensioen." Dit vertraagde effect maakt het lastig om direct actie te ondernemen en verantwoording af te dwingen. Volgens de FNV speelt het tekort aan handhaving een cruciale rol. Van Doorn stelt dat de Arbeidsinspectie jarenlang is uitgekleed door bezuinigingen, waardoor controle en toezicht te wensen overlaten: "Er is de afgelopen tientallen jaren heel erg bezuinigd op de Arbeidsinspectie. Dus wordt er heel weinig gecontroleerd." Momenteel zijn er slechts 33 inspecteurs die toezicht houden op ongeveer 100.000 bedrijven die werken met gevaarlijke stoffen. Dit betekent dat de kans op controle klein is en bedrijven nauwelijks worden aangesproken op nalatigheid. Ondanks deze ernstige signalen heeft de Tweede Kamer recentelijk een motie aangenomen om de regels voor gevaarlijke stoffen te versoepelen, vooral voor het mkb. De motie stelt dat de huidige wetgeving "onwerkbaar" is en pleit voor een meer toegankelijke werkwijze. Uit onderzoek blijkt echter dat juist kleine bedrijven de registratie van kankerverwekkende stoffen het minst goed op orde hebben. Van Doorn is kritisch over de versoepeling: "Aan de ene kant is duidelijk dat bedrijven hun verplichting niet nakomen, en aan de andere kant versoepel je de regels nóg meer. Daardoor wordt het nog moeilijker om blootstelling aan schadelijke stoffen zichtbaar te maken." Dit zorgt voor een situatie waarin werknemers onnodig gevaar blijven lopen zonder de juiste bescherming. Summing up his disagreement with Sartre he remarked: "it has always seemed to me that ideas were somewhat more real to him than people.” Was Baldwin right that to be alive is to be socially connected to others? Or is Sartre's insight that the only thing we can know is our own experience more telling? Should we conclude that we cannot understand the experience of another unless we have had the same experience?
